A particular matter has arisen at my husbands workplace regarding a problem with a shoplifter. Where the he manager caught him in the act and followed thru as the law permits ie saw in the act , followed him thru the store, confronted outside etc.. During this confrontation the manger asked for the item back the shoplifter obliged, then the manger asked if he had taken anything in the past and the shoplifter replied "yes, man I don't need any trouble with the cops, if I leave my jacket and shoes here as collateral and bring the stuff back will you not call the police?" Considering his options the manger agreed. The man never returned.
A few days later an employee that witnessed incident was realying it to another and it spread. A few days later the loss prevention personel came into the store and started doing interviews. The manager has yet to be interviewd but is wondering if he should consult an attorney before proceeding with the interview with loss prevention? And if he does not have that right is he obligated to "write a statement of the conversation" , and if he refuses is that grounds for termination? The loss prevention person has a fiflty habit of lying to the person under investigation in order to get a "full confession" . Though here there is nothing to confess. Does he have the right to have a witness in the room?
The manager knows that he has done nothing wrong morally though wonder if this exchange between he and the shoplifter was illegal some how? And he could perhaps be fired for such an act? Any insigt would be very helpful. My familys livliehood is at stake.
