I am an attorney in Pa. My brother lives in Michigan and he told me the following: Last year he was pulled over for speeding. The car was searched and a pipe was found. The office gave him a speeding ticket, charged him with possession and let him go. He later got a letter from the Court stating that the possession charge was dismissed because all he had was paraphernalia, no actual drugs. This past week the local cops came to arrest him, claiming there was an outstanding warrant. He produced the letter, and was told the cops that issued the warrant had reinstated the charges.
I have been doing some research, and so far have not found possession of paraphernalia in the MI crimes code.
Any thoughts about (1) the charge and (2) reinstatement of the charge a year later?
