    Default Housemate Gives Bad Check, No Rent, Not Clean and Hides

    please help!!! I know what I have to do, but I feel bad about it. I own a mobilehome and needed a roomie to help make ends meet. I knew a 20 yr old girl (I am 44) at work that needed a place to live and so we went into an agreement on rent, utilities and household duties such as cleaning her room, "guest" bathroom which was hers to use, help with the house work since she had free use of the house and basicly to clean up after herself. She has been here since mid July and I began the agreement aug. 1st to help her out alittle. I helped this girl get a bank acct and set up direct deposit with her work so she didnt have to cash her check at one of those check cashing places. I also TRIED to teach her how to keep track in her check book and budget her money to no avail obviously because she gave me first bad check last month for her half of utilities. Now I havent had a problem with her financially up until then... only with being clean, not doing her part and me having to do everything around the house besides cleaning up after her. I was continuely after her about her laziness and being a slob, but I needed her financial help. Well when I found out that she had no monies in her acct to cover the returned check I called her at work to let her know then I, myself had to go to a cash loan place to cover her part of the bills. On 10/28/2005 I gave her an invoice once again stating she owed for the bad check amount, novembers rent that was now due (as of the 1st) and the charges I had to pay to cover her returned check. All this time she has hid in her room and/or would avoid the subject of what she has done to me and what she owes me. Going on as if nothing has happened and still her hygiene hasnt changed. In our agreement we agreed to terminate by 30 day notice either way. I am not sure I can let her live here for another 30 days without worrying myself into a heart attack or loosing my job (called off tonight to serve her notice and had feeling she was going to come back while I was at work and move out her things along with some of mine). Do I have to give her 30 days notice? Can I get key from her and let her in while I am at home? PLEASE someone help me!!!!! Thank you

    Default Dirty Deed Done

    OK FOLKS I KNOW I DIDNT HAVE THE TIME FOR ANY REAL ADVICE TO BE GIVEN TO ME BUT I WAITED FOR HOUSEMATE TO GET HOME.... ASKED HER IF SHE HAD THE AMOUNT OWED AND TO HER REPLY OF "NO" I ASSUMED IN READING HER NOTICE THAT SHE HAD 3 DAYS TO PAY WHAT SHE OWED OR MOVE OUT AND IF SHE DID THEN SHE HAD UNTIL THE END OF THE MONTH WHICH WAS TO BE HER 30 DAY NOTICE. I HOPE AND PRAY I DID THE RIGHT THING AND TO COLLECT WHAT IS OWED I GUESS OFF TO SMALL CLAIMS I GO....

    Default lodgers

    hello!

    If you own the unit and live in it, then you can claim she is tresspassing. See california civil code 1946.5

    she is not a tenant, she is a "lodger", and the state law says that after you have given 30 days notice, you can have her removed for trespassing!
