My question concerns child support and ssi. I have three of four of my children currently living with me. The youngest (my only girl) is recieveing SSI. My child support amount has been decreased substantially (from $716 down to $302 per mo) partially because my oldest son has moved out but primarily because the las animas county child support enforment agency has now included my daughters ssi payments $534 mo ( I am the payee ) as income and placed it on the child support work sheet as income that diminishes the need of a child which in turn has decreased my support for three children to $302 per month even though my ex husband grosses between $2800-$3200 per month. it seems as though they are using the supplemental support to supplement his child support payments rather than as supplemental income for my daughter. Can this be right? SSI uses child support amounts to determine the amount off ssi a child recieves so how can child support enforcment use the amount of ssi to calculate a childs support order? I have argued with las animas county for well over a year on this issue. They stand firm on thier calcualtions and REFUSE to do any sort of modification. mean while each time i call my case worker or her supervisor gets short with me and quite rude. It is thier job to establish support for the children not to cut either parent a break some how i feel they are deliberatly "screwing my children" out of the support the need and deserve. does anyone know if i have any recourse on this matter and how i can find out the laws regarding ssi and child support? the ssi web site does not address this issue I have also called social security who honestly cant answer my question. I am a single parent with very limited income i can not afford an attorney. I have tried legal aid but since i live in a completly different county now the best they can offer me is help on filing the forms which i thought was what las animas county child support enforcment was for.
