    Default Child On SSI And Decreased Child Support

    My question concerns child support and ssi. I have three of four of my children currently living with me. The youngest (my only girl) is recieveing SSI. My child support amount has been decreased substantially (from $716 down to $302 per mo) partially because my oldest son has moved out but primarily because the las animas county child support enforment agency has now included my daughters ssi payments $534 mo ( I am the payee ) as income and placed it on the child support work sheet as income that diminishes the need of a child which in turn has decreased my support for three children to $302 per month even though my ex husband grosses between $2800-$3200 per month. it seems as though they are using the supplemental support to supplement his child support payments rather than as supplemental income for my daughter. Can this be right? SSI uses child support amounts to determine the amount off ssi a child recieves so how can child support enforcment use the amount of ssi to calculate a childs support order? I have argued with las animas county for well over a year on this issue. They stand firm on thier calcualtions and REFUSE to do any sort of modification. mean while each time i call my case worker or her supervisor gets short with me and quite rude. It is thier job to establish support for the children not to cut either parent a break some how i feel they are deliberatly "screwing my children" out of the support the need and deserve. does anyone know if i have any recourse on this matter and how i can find out the laws regarding ssi and child support? the ssi web site does not address this issue I have also called social security who honestly cant answer my question. I am a single parent with very limited income i can not afford an attorney. I have tried legal aid but since i live in a completly different county now the best they can offer me is help on filing the forms which i thought was what las animas county child support enforcment was for.

    You'll have to explain to me how you feel like you're being screwed. By your own admission, you were receiving $716, but with the SSI payment and the child support payment, you now receive a total of $836, which is $120 more than you were getting.

    You weren't looking for your daughter's SSI payment to supplement your income, were you?

    actually yes i am ssi is strictly for my daughter and can only be used for things relavent to her! Do the math yes i recieve $846 per month but over half of that is basically welefare and i DO NOT want any assistance if there is an alternitive the person reaping the TRUE bennifits for my daughters SSI is her ABSENT FATHER who has a HUGE break in taking respnosibility for children of whom he has a LEGAL OBLIGATION to support My daughter isnt recieveing SUPPLEMENTAL income her ssi IS her income and my sons hmm $100 a mo per child wont even BEGIN TO FEED THEM do you ven have kids????

    Wait a minute. Your daughter's income? Not hardly. What did she do for a living and what was her income prior to them deeming her disabled? What is your responsibility to assisting in the support of your child? If it is "basically welfare" and you are so against the "welfare" when why apply for SSI on her behalf? Seems to me that you are a bitter woman who is angry at her father. He is meeting his court ordered obligation towards support and that just ticks you off. That does not a lawsuit make. That makes you in need of psychological attention, not an increase in child support. If you feel that the court ordered support amount is not sufficient to meet the needs of your household, then you need to make extra money.

    And oh.. by the way, what is it exactly that you spend $534/mo on and it's not enough. Remember, you're responsible for supporting your kids too.

    I'm not understanding something? My sister has a step son who is disabled the SSI money is suppose to cover the cost of the things associated with his disability that medical coverage does not. Which includes but not limited to the mom hiring somebody to help care for him (specially trained sitters) transportation costs and things like that. So when her husband went for child support modification this last time that amount was NOT included in the equasion as income for the mother. Only her income at her job was counted. That was in NJ.

    firstly, unless you have a disabled child you have no idea what it takes to raise AND COSTS to raise them. secondly SSI is exactly what it says SUPPLEMENTAL SUPPORT INCOME and yes IT IS MY DAUGHTERS FOR THE SUPPORT AND CARE OF HER AND ALL HER SPECIAL NEEDS i have to sign a waiver every year stating all her ssi was used for HER SUPPORT i cant buy my sons shoes with her money so why was thier support decreased however i can use it to pay rent and utility bills where ever SHE LIVES !! it is not ment as a replacement for child support or a parents income COURT its a supplement to help with the added costs of taking care of an individual with special needs. further more I DO NOT WANT BOTH i would rather my child recieve child support instead of SSI but because her dad has USED AND I DO SAY USED SSI AS A MEANS TO DECREASE HIS SUPPORT OBLIGATION I cant afford to take my daughter off . no wonder welfare is going broke parents like me who are forced into governement assistance because dads like that will do the bare minimum required and if it wernt a law would not pay at all. why does ssi have to supplement monies a father should pay? if my daughter didnt recieve ssi then he would have to pay the 800-900 a month instead its the tax payers who foot the bill for him because moms like me cant make it alone.(and bty I AM A TAX PAYER TOO)
