    Default Robbed By My Dad

    I own a cell phone which i pay for, my parents dony pay a cent, I actually havent asked my parents for money in over a year. so my dad comes home stressed from work or something i guess, anyway he takes my cell phone and my wallet. then proceeds to go to my rooom and smash my cd's and cologne and other thing that I paid for. I talked to a cop and he said "this is between you and your father and you live in his house" so after i argueed with him this is my right to file a report he tells me "since you live in his house he can do this"...... is this true? what can i do please help. i worked hard for my phone and cd's and cologne and my money. i want no trouble just my cell back but i will do what i takes .Please respond

    Yep! If he owns the house he can walk in it and smash every window and every door and it would be perfectly legal.
    Try waiting until tempers calm a bit and talking to him. This too shall pass.

    Just FYI - the answer would have been different if you were over 18 and a rent paying tenant and he was just some random landlord.
    That said - if you are in physical danger then you can call 911 - he is NOT allowed to hit you - just your stuff.

    Oh come on guys. Dad is not able to trash anothers property regardless of the fact it is his kid and the kid lives in dads house. Persoanl private property is just that. A minor can own their own property. The problem often is police do not like to get in the middle of domestic situations and often act only when there are injuries.

    Being a minor does not give dad carte blanche to trash your personal property.

    Call the prosecutors office and request to file charges there rather than the police making the determination.

    Technically true. This would be a very difficult case to prove, though. Dad could just claim the property belonged to him. Not many police officers are gonna take the word of a teenager over a grown man.

    I doubt the prosecutor's office will intervene in the police determination, there having been no violence directed at another person. I suspect also that there is more to the picture here than we've been told; but isn't there always....
