    Default Taking Your Child Away From The Other Parent

    Hey all, first post...
    State: Florida
    I've got a close family member who is, I think, about to make a big mistake. This family member is married and has a daughter going on 3. She is not happy in her marriage and is very close to leaving with her child against the fathers will. Their current living conditions aren't that great but they're not dangerous as far as I know. She just says that she doesn't love him anymore. The property and home are owned by the fathers, father who also lives there. They just don't have much money. The father is working and she is not.

    Can the father press any charges if she leaves and takes their child against his will?

    Where does she plan on going? In state? Out? Hiding the child or just moving across town? How does she plan on feeding and housing this child?

    She can move with in the county she is currently in but IF she plan on moving out of county or out of state the father (if he's smart) can file a motion for the return of the child to the courts jurisdiction.

    In state, but several hundred miles away (out of county). She won't be hiding the child since she would be moving back in with her mother - so the child would be taken care of.

    I was just worried about some sort of criminal action against her.

    No, at this point, both parents have equal rights to move with thier child. At the same time, the other parent does have the right to file in court to have the child returned to the county.

    The best way for her to do this would be to:

    1. Get a job.

    2. She can find a small apt in the same county with the help of some local agencies.

    3. As soon as she moves out ( Should be the same day) she should file in court for a custody, visitation and CS order.

    The worst thing she can at this point is to move to another county, or even move without filing for custody.
