I agree with you Carl and I understand the law. My point is that although one is obviously greater than the other, one is a felony and one is a misd. but why shouldn't he be charged? And I know that we don't know if he has been or hasn't been or will be. What I would expect is the adult to know better. She is wrong and will have to face that herself. I also would expect any 14 year old to know that it is illegal to consume alcohol.
Excellent point and one not to be overlooked, but always is. The minor of fact knows the action is illegal yet is not prosecuted. That is a double standard. I realize the lady is the majority at fault, but as the saying goes "it takes two to tango". And BOTH parties should be prosecuted equally. The boy in this caes is guilty of alcohol consumption and illegal sexual contact, both misd. The lady is guilty of stat rape.

Oddly, the lady's father, who comes here looking for help and advise, and is guilty of nothing, gets beat up and accussed of possibly sexually assaulting his daughter and being a poor father figure. Yea, thats really helping, isn't it??

No ... it is an exercise in discretion.

Besides, the consumption of alcohol was not witnessed, and very few prosecutors in this country prosecute such minor offenses on third hand information ... there is no proof of the consumption, and an admission is insufficient - by iteslf - tuo sustain a prosecution. In my almost 18 years on the job I have NEVER seen a case prosecuted when it was a second or third hand report of consumption or possession AFTER the fact. Even if the girl had not been charged, the chances of anything being done with a two or three day old report of alcohol possession by a teen is next to nil.

The boy in this caes is guilty of alcohol consumption and illegal sexual contact, both misd. The lady is guilty of stat rape.
What "illegal sexual contact" is the boy guilty of? How can HE be guilty of molesting an adult?!?

And in some states it perfectly legal for a 24 year old to "do" a 14 year old.
What state in the union do you know of where the AOC is 14 and it is ok to have sex with a 24 year old?
