    Default Contempt/Change Of Custody In Alabama

    Greetings, looking for insight here.

    Case summary

    received joint custody/visitation with the mother having physical custody

    Mother has violated just about every order in the decree

    been arrested since divorce

    has been violent, left threatening voice mails

    denied and interrupted visitation.

    Trial coming up and I am asking that physical custody be awarded to me, with her having visitation. And I don't want any support from her.


    Insight, what are my chances, anyone been in a similar situation? Thanks for the guidance, advice, etc in advance.

    Based on the 4 things mentioned, you should get custody.
    However, there's going to be alot more than 4 things brought up at the hearing. It takes alot for a change of custody. Good luck to you.
    And 1 more thing. I get aggravated when a parent says "I don't want support from him/her". 1st of all, that won't sway the judges ruling. It's not like if the judge is on the fence and he thinks "welllllllll, Mom doesn't have to pay support", oh what the hell, yeah, that's the deal breaker. Congrats dad!"
    You ask for whatever the guidelines say. You take that money, and you put it into a trust fund, CD, College education interest bearing high yield account, and you sit on it. When junior applies to college, you won't have to worry, and can make sure he/ she gets the best education possible.
    $200 a month, over 15 years at 4%. that's over $100k for college. Princeton here we come ( for a couple years anyway )
    I've never met anyone who, doesn't need extra money. No matter ho wealthy.

    Thanks for the reply. Yes, there will be much more brought out in the case. We actually had a hearing scheduled, she filed a mtc the day before, she showed without an attorney, so the Judge gave her the a chance to get representation and reset the trial. I will be gald when this is over. I have stuck strictly to and abided by the dd no matter how much she hasn't. Sometime people think they are getting over but there is a "HIGHER" being looking over us all.

    It's sad, but some attorney's will advise their father clients to not ask for CS- makes me sick. I know of one case in FL right now where the father was given custody, had temp custody for a year, and his attorney REFUSED to file for temp CS from the mother. Dad was advised to file on his own, believe it or not his attorney threatened to drop him if he did that! I've also seen it happen in other cases, I just don't understand why anyone would think that a mother should be exempt from financially supporting her child just because she gave birth to the child.
    LOL- okay, I'm done with my rant for the day.
