    Default Retail Fraud by employee

    I was accussed of retail fraud. Specifically it was raincheck fraud where I issued substitutions from one video game(NOT systems only game titles) to another. The store allowes substitutions regularly on sales items, and these were.
    At the time of each transaction(six in all), I was not aware that what I was doing was wrong. The first time I questioned in my mind, but failed to see the issue. No one ever confronted me about any transactions, asking or informing me that it indeed was wrong.
    Two transactions did take place with me and another employee where we each bought and item substituted at different times. I agreed that I completed each transaction, and exclaimed at the time I was not aware it was wrong, but after they explained it, I understood. This was constituted as fraud and I agreed to pay a total of about $90.
    I was verbally told that nothing would appear on my record so long as I paid. Indeed I payed. Two months later, I was asked to turn myself in via a warrant for retail fraud.
    The complaint was filed with local police ten days after I was fired. Now I face a criminal record and possibly 93 days in jail. At arraingment I plead mute, not guilty, and was NOT appointed an attorney or the fact that I could have even one.
    I was not arrested, but I was booked(fingerprints and mugshot). I've never been in trouble before...EVER. I paid the agreed total, and the recovery division has it on record as recieved one month and one day after I was terminated.

    I do not have a problem with repaying(which I did).
    I do not want my job back(infact, I just started taking classes to get my GED). The job was too stressful.
    I feel I do not deserve a criminal record, and any jail time.

    I have a pretrial scheduled in about a week.

    What should I do? Is there anthing that I can do?

    Default Retail Fraud Criminal Charge

    I would strongly urge you to consult with a criminal defense lawyer about your situation. If your record is clean, and the defense attorney believes your defense is playsible, you may be able to work out a satisfactory resolution without going to trial.

    If you want appointed counsel, check with the court to see if they can provide you with a petition to have a lawyer appointed. Typically, there's a form to complete to request an appointed lawyer. Otherwise, consider at least consulting with a private lawyer who offers a "free consultation" (or a cheap consultation), to help determine what your best approach is, and decide if you wish to retain the attorney at the conclusion of your meeting.
