Angry Can My Son's Friends Be Sued For Providing Him With Marijuana

I am a NC resident, father of a 16 year old son.

My son is like other stupid, selfish, short sighted kids. He was suspended last year for pot possession at school - he was actually high at school. We decided to put him into military school.. under the naive belief that that they would straigten him out. Well, two weeks ago he was expelled for testing positive. Summarily dismissed.

So, now we are in a position where he can't go back to public school, and has basically dropped out with less than a GED. Great.

I am livid with him, and I think he is the main culprit. We have tried everything to get him to alter behavior. No luck. He has a miguided circle of friends who think getting high is the end-all.

So, here is the question: Can I go after the friends he hangs out with? They are all over 18, some of them over 21. I know they provide the pot, and they allow him to hang with them while they all party.

When I looked up the laws in NC, it stats that sale to, or employing a minor, is a felony. If you are older than 21, it is 2 classes higher.

Now, understand, I don't really want to destroy other peoples lives. I know these kids are all idiots, but I am really hurting with this behavior, and I feel that these other kids are at least partly to blame for the mess our whole family is in.

Is there any civil action a parent can take against drug users who influence their kids?

    Other advice is appreciated.

Wait, was he just suspended or was he expelled? Suspension doesn't usually get you kicked entirely out of school.

Is there an "alternative" school in your town? We have several here for JDs, administered by various school districts and social services.

As far as I can tell, your options are to sue your son's friends under the relevant statutes (provided you have proof that they are providing the weed) and keep him away from them or just keep him away from them.

Get him into an alternative school or a GED program and keep him accountable for every minute of every day. He won't like it, but he'll be safer.

    Hi,

My son was suspended from public school, expelled from military school.

Like most counties, we do have special schools that deal with suspended
kids. I am not sure he is willing to buckle down and actually go to school.
Also, the downside with these schools is that there is a concentration of bad kids, (which was the case at military school), and then you kid's bad behavior is considered normal.

The question I have though: If you are over 21 and in the same room as a minor who is also smoking pot, does this put you at an increased legal risk? I really want these older kids to throw my son out on the street and not let him party with them. I don't give a crap about their behavior...

How about a civil order of protection? They are adults and your son is not.

    Doing this won't change anything

I have a Master's in counseling and spent 25 years involved in the drug world. I have also had legal troubles resulting from living that life. I work with substance abuse, sex offender and anger management clients. I have also raised my own son who is now 17. His mother spent 5 years in prison resulting from her drug addiction to crack cocaine.

If you need suggestions say so or pm me. I have seen and heard it all

    SADude -

Just wanted to say a quick:
"Wow! We are really lucky to have someone like you out there".

Let's hope that someone with your skillsets is available to help this kid un-screw his life. For now he is screwed.
