    Default Inmate Rights To Mail

    I have a question as a inmate whetther they can have thier mail taken away. Isnt that against thier rights? They decided to take it all away from the pod for they whistled well someone whistled at a female guard so they all got punished by not getting visit and taking thier mail away for a week. This is in New Mexico.

    You mean, their mail is held and they get a stack of mail at the end of the week? That wouldn't be impermissible.

    It's jail/prison.

    Priveleges can be taken away. Well, except for Cable in some states. That's why Sheriff Joe has the Weather Channel and Disney only.

    Their mail can be taken for a review to determine if anything in it incited the bad behavior.

    I agree, I can't remember the case I read, but it was found that it was not unconstitutional to withhold inmates mail as a punishment.

    It is against the law to with hold mail from an inmate. Now if it was mail that was already received and is old mail that the inmate is storing. Then it can be considered property and not mail. There for no law was broken.

    Mail is only considered mail until it has been received by the inmate and the inmate has opened it. At that point it is considered personal papers. Jails and prisons have regulations on how much personal property an inmate can have.
