    Default Walk-In Clinic Lacks Care

    Last year I had a problem with a walk in clinic that later avoided me by phone and in person concerning requests for RX refills and decided it was best to leave and filed a complaint with the state Health Board. Should the complaint not be thrown out about the doctor can a small claims for negligence be an option ??

    What medication were you trying to get?

    What would constitute "malpractice" about their choice not to prescribe medications for you?

    A doctor is under no obligation to prescribe you any medication if they do not think you need it or write a prescription for what you want. That having been said, with the exception of drugs that are scheduled narcotics, most doctors (even walk-in) will perform whatever steps are required (even having their staff call your primary care physician or PCP) to validate that the medication you are requesting is what you need.

    If the doctor opines that the medication is not medically necessary or they don't have the equipment or tests to determine if it is safe to prescribe the medication then they can decline to prescribe it or prescribe something totally different.

    IF that doctor failed to prescribe you medically necessary medication and you later had a problem within a few days then you *may* have a case if they don't have recorded notes for that day noting that they told you to see your PCP ASAP. They can also refuse to prescribe and tell you to see your PCP or give you a sample pack to tide you over.

    You can take someone to court if you think you have a case; you might not win and they might file a counterclaim for their loss of time defending themselves.

    ...and if you go into a walk-in clinic looking for pain management meds you are SOL even if you are in pain.

    ...if the State BOH or BOM sided with the Doctor you are likely SOL in court. Yes, you can file, but you are likely SOL.
