I have a complicated situation. I was hurt at work and the claim was accepted then I was fired while on WC. My attorney has filed the 132a and I have the termination in writing. When I was released and P n S the TTD stopped I applied for unemployment. The employer denied it stating " left on personal leave and voluntarily quit." My question is this " What is the action against an employer who has committed fraud and lied and once again this is in writing ?" I do not want to simply appeal and receive unemployment. My question is mainly " What happens to the Employer for committing fraud and lying?" " What is the fine ? " Lying to a federal institution especially in my case which is a little more involved. My employer has completely cut me off. I can not receive unemployment and cannot gain new employment because of the reference they are giving. Is the EDD situation separate from the 132a ? or Do they have to compensate me for this lie to the EDD in the settlement or should I hire another attorney for this? or Should I not settle and take this to court? Where I am you can set a trial date quickly!
