Civil demand is an action the the retailer brings against you directly. Hence the use of the term "civil".
Restitution is the court ordered reimbursement, payable by you to the court. Then the court forwards it to the retailer/victim.
The "demand" is a civil proceeding. "Restitution" is a part of the criminal proceeding.
Yes, most cases of prosecuted shopliftings result in BOTH. You get to pay the demand AND restitution!
In that SPECIFIC instance such is the case. In my 'hood we always do both.....
.....you get the civil demand and we prosecute. AND sometimes you get ordered to pay restitution, even if we did make a 100% recovery of the stolen stuff.
All depends on the "mood" of the court............
I keep reading these posts that say the retailer makes civil demand, and if you pay it then they won't prosecute criminally. If you don't pay, then they press charges. First of all, this is basically retail extortion. (or is blackmail a better word?) It is against the law for a retailer to tell you to pay the civil demand or else.... Does the retailer have to answer to charges for this?
