I know understand that if the employer simply doesn't respond it doesn't matter and you are approved for benefits provided the reason is laid off due to lack of work on the employees claim form.

What's your question?
If you lie on your application for UI and say that you were laid off for lack of work when in reality you lost your license and couldn't perform your job duties any more, and you get benefits because your employer doesn't respond, if the UI office ever finds out that you lied that means that both you and your employer will be in trouble for a fraudulent claim.
Being unable to work because you lost your drivers license is a DISQUALIFIER for benefits. If you and your employer want to join together to defraud the state so that you can get benefits you are not entitled to, on your own heads be it.
Our business is always slow this time of year. Like other types of business they (employers) ask for voluntary layoff, I refused and a few days later this problem with renewal of my license came to light, so my employer asked again for voluntary layoff at this time I took it, he isn't responding because he is overly busy, doesn't have time and doesn't need to., so it comes down to these two combinations of layoff and non-renewal, but the more I seem to explain in a honest way the more complicated people make it. This is simple isn't it, I know he won't respond his time is measured in minutes and just doesn't bother with extraneous things, I need to know now cause my determination is weeks away and I need to feed my family so I am looking for an educated guess, not an emotional guess, I will need to move and find different employment if I think the claim won't be approved.
so I am looking for an educated guess,
And that's what you got. The fact that I feel strongly about people lying and cheating to get benefits they're not entitled to doesn't mean I don't know what I'm talking about.
