    Default Rest Period Requirements

    Ok, I live in West Virginia. The Company I work for is in West Virginia. I work for an inventory company and we Inventory stores in WV OH and KY. We will be in Kentucky this week.The Kentucky DOL website says that for every four hours worked a 10 min. break is required. Does this mean that I get a break in the middle of the 4 hours or can my boss work me 4 hours give me a lunch and work me for another 4 hours without a break? He says he can work us as much as he wants and doesnt have to give us a break because we get an hour lunch. He also says that since I live in WV, Kentucky law ddoes not apply to me. Is there any truth to this?

    The law applies in the state where you are working - the same answer you got on the other forum you posted on.

    Employees in Ky. are entitled to a paid 10-min. break for every 4 hrs. worked & a "reasonable period" for meals (ordinarily 30 min. or more) no sooner than 3 hrs. or later than 5 hrs. into the shift. Meal breaks are unpaid as long as they are duty-free.
