    Question Crimes Involving Moral Turpitude

    My husband has been appearing before an immigration judge for the past three years in the hopes of getting asylum. He was originally detained four years ago. A couple of days ago he went before the judge and a decision was made to detain him. The prosecuter brought to light an incident that happened several years ago. My husband having being stopped for speeding gave his brothers name, who is in status, afraid he would be arrested since he (himself) was out of status. Later he felt remorse for what he had done and went to the police station and owned up. He was held and sent to jail. He spent months in Jail, some in solitary confinement. He was later released.

    The immigration judge and prosecuter have always known about this incident. It is the only thing close to a criminal offense he has on his record. For some reason it has suddenly become an issue with the prosecuter and he says a crime involving moral turpitude. which makes my husband subject to mandatory detention.
    I would like to know since these crimes are to do with a persons moral character does he have a chance since he originally turned himself in and confessed what he had done? Is it really a crime of moral turpitude? They have split the incident into two charges, impersonating and attempting to avoid arrest(something like that). Each being considered as a separate crime of moral turpitude.

    I have been trying to get him legal help i do not have enough money to pay the the $5500 that his former attorney is demanding. I do not know what my husband is facing or if he is eligible for a bond. He has been in jail for three days now and will not have a hearing until he is moved to another facility. Is it likely he will be deported or is there something we can do to fight this thing? I have been unable to get free legal help as all the associations around my area are not taking new cases. I will greatly appreciate any advice. He is originally from kenya. We are in Pa.

    Your husband apparently has been convicted of two crimes involving moral turpitude. Your diminishment of those convictions ("the only thing close to a criminal offense") doesn't lessen the fact that they are criminal convictions.

    The prosecutor appears intent on deportation.

    Thank you for your comment i am in no way trying to diminish the convictions.

    My husband had just walked out of a hearing with his judge when they detained him. The said convictions have been known by the court from the begining and both the judge and the prosecuter had said the convictions did not pass for crimes of moral turpitude. He was once detained by immigration and released. Even then these charges were known to them. Why was he released only to be detained again on the same charges. it was never an issue during the hearing.

    I am confused about who it is that made the order to detain him. Now that i know it was not the judge. Do the agents routinely detain people over the same conviction only calling it a different name each time? I am really confusd about this. I received a hearing notice today for my husband to appear a month from now with the same judge right here, just as the judge had told him. It was mailed a day after his detention. How is this possible when they know he is detained and being sent to a holding facility out of town? I am now afraid they will order him deported when he fails to show up for this new hearing and be ordered deported in his absence.Should I be writing to the court telling them he is datained?

    My financial problems have made it really hard to get an attorney. I just need a bit of advice some insight into this whole situation from anyone ot thre that has knowledge about such things. I dont know what is happening, what I should be doing or what is likely to happen. Deportation has been my biggest fear specially now that you mention it. If the judge rules in his favour as far as asylum will they release him? And if so, If the prosecuter appeals, how long does it take for the board to review it ?
    Do these charges bar him from all relief ? Are there any waivers available? Extremely Distressed. Any advice please!
