Ok, I just got a supeana today. (Thought it was an officer for my insurance info because my fiance rolled my explorer earlier that day)

This is from a credit card that I last payed on in I believe early 2001. The last amount was for 280. The first debt collector called me in 2004 I told them to get lost. The second collector in 2005 saying, same thing. In 2006 a new collector, Liberty Credit Services LLC from Minnesota calls and tells me I owe them 1500. I told them that the debt was invalid. After 2 days of this I finally sent them a letter disputing the debt and asking for validity. I also informed the Iowa attorney general when all they sent me was a Microsoft Word Document with "their" bill and a generic bad photocopy of the credit cards policy that was "NOT" signed by me.

They told the Attorney general that I had said that I bought a necklace with the card which would have been around the time I was married and I didn't buy that woman anything for any reason. So they blatently lied right there. I denied owing the debt as the statute of limitations had run out.

They had also told me that if I didn't pay that they would sue me. As far as I know in the state of Iowa it is illegal for a debt collector to threaten a lawsuit without intent to actually do so. This was around Febuary 2007 and I havent heard from them sense untill almost a year later.

Do I have a case? They say if I call them now they will settle for 800! I would have paid the 280 but they said they wouldn't take any less then 1500. I'm used to just settling but I'm tired of being pushed around and we all should be. Untill we ALL fight back and stop just making it go away with settlements, will these guys go away. Anything I missed just let me know. Thanks.
