    Default Summons And Complaint

    I am filling chapter 7 bankruptcy in Ohio without a lawyer. I received a letter from a creditor for a student loan. The student loan is not through the U.S. Gvt but through American Education Services. It states in short that I can discharge this debt if I file a complaint on the basis that payment would present undue hardship. It says that I must file a Summons and Complaint. The only forms that I have found are for creditors to file, not debtors. It says that if I don't do this, that after the discharge they will resume the collection process. Can any one offer any suggestions please.

    Suggestions? Hire a lawyer. The odds of getting out of your student loans are small enough with a lawyer.

    Beyond that, you can use PACER to examine other court files to try to see how things were done in similar cases, or see what access you can get at the courthouse.
