    Default Dealing In Stolen Property On eBay

    My husband sold several items on eBay, not knowing the items were stolen. He hasn't been charged yet, but the investigator says it will likely be 1 count of dealing in stolen property per item (around 50 items). We live in FL.

    1. What is the likely sentence he would get if he went to trial? We have a few pieces of info that support the fact he didn't know it was stolen.

    2. What is the likely sentence he would get if he plea bargained?

    3. What fee should we expect to pay a lawyer for this? I've been given a quote of $10,000 and have no idea if that's the norm.

    4. Should we have to give the lawyer the retainer before finding out the charge or before plea bargaining? It seems a high amount to pay if we can plea bargain.

    It's impossible to guess what the outcome of a trial may be. That's why we have lawyers.

    The FL statute is pretty harsh:

    812.019 - Dealing in stolen property

    1. Any person who traffics in, or endeavors to traffic in, property that he or she knows or should know was stolen shall be guilty of a felony of the second degree.
    2. Any person who initiates, organizes, plans, finances, directs, manages, or supervises the theft of property and traffics in such stolen property shall be guilty of a felony of the first degree.

    If you're not comfortable with the attorney's fee quoted, ask around for recommendations. Nearly everyone knows someone who either is or knows an attorney. Your attorney friend-of-a-friend can point you to a criminal defense attorney.

    The fee of 10k for 50 Felonies is likely a bargain because this will have to go to trial by jury to prove your husbands innocence. A good defense attorney can select a good jury pool and argue the case.

    ...and if there is a theft ring that provided these goods to your hubby they might want him to help take the ring down, which does have some dangerous points.

    Only a good attorney can navigate the waters.

    I would expect to pay between $5,000 and $30,000 dollars, dependent upon the complexity of the case and the evidence.
