    Question Sexual Offender Registration Guidelines

I live in Texas right now and i am trying to figure out what a convicted sex offender has to do in each state when they register. I understand it varies from state to state i just cant seem to find a site that has these guidelines. My husband is in prison and although i know he is innocent he was convicted therefore we needed to find the safest state for him to live in and make a living in. I am angry about the conviction but have faith that it will be over turned on appeal...however...hope for the best and plan for the worst so im trying to figure out where to go next for information. Any help anyone can give me would be appreciated. Thank you.

Your first step is in finding a place that you want to move to and find out from that county's sheriff's dept what the requirements are for proper registration and what the local and state guidlines are, such as living/working near schools, churches, playgrounds, etc.

There is no such thing as a "safe" state for sex offenders, but there are states that are more relaxed in requirements.

Georgia just overturned a law prohibiting offenders from living or working within 1000ft of such areas because the way the law was drawn up, an offender could own a home or business and a new school could be build nearby and the offender was automatically in breach of the law.

You also have to consider whether your husband will be able to move due to probation or parole restrictions. If you give some idea as to where you are considering moving to, perhaps more useful information can be made available to you.

    What was he convicted of?

I see by your other thread you have young children...You may want to find out if he will be able to live with your children. You may also risk losing custody of your children if you bring a convicted sex offender into your home.

We really arent sure where we want to live. We've thought about Florida dn georgia knowing he may be able to find work there but this could also and probably will impede his employment capabilities. He was convicted of two counts of indecency with a minor. What i really want to know is how we can fight this because of how his rights were vilolated in Iraq and here in the states. I know the evidence shows him being innocent he simply wasnt found innocent. Im not sure who to go to or what can be done...he still has his appeal but ive been told the odds of that are like 80 to 20...i feel completely powerless. How can i help my husband clear his name and save my family?

According to yur blog your husband CAN NOT be around your children. Are you placing your children elsewhere in order to move with hubby?

They went for visitation and came back in need of deep therapy. He emotionally abused my son and daughter to the point of them both needing to see someone weekly for six months. However, both children are doing fine and a lawyer is working on a new visitation plan for next summer. Thanks for all your comments.
Has the 6 year old that was molested by your current husband been in counseling?

My daughter has been in therapy since this all began. Her therapist agrees after seeing her for 16 mths that she was not molested. I always treated the situation with my daughter as if it were true. My husband did not see her or talk to her. She was suppoted completely and is very loved. I am absolutely not going to give my children up to live with my husband. Actually, although I love him deeply and am willing to fight this cause until the truth is seen i am not going to lose my children to stay married to him. Therefore he and I decided that it would be best that we not try to find a way to live together. However, there is a major misjustice here and i am willing to do whatever it takes to show the world how he was treated in iraq and how the children and i were treated by cps and the army through this entire ordeal. If i can make it so just one person isnt manipulated and abused the way my family was then it might make this positive to my children. They need to know that just one person can make a difference and im trying to show them just that.

You live in the great state of Texas (YEE HAW!!)? Well, I can tell you this: Only home-rule cites have the power to place these kind of restrictions on them offenders. I know this because my local mayor and I discussed a policy to limit where sex offenders live due to the high number moving itno our community. But alas, we were unable to pass such a law due to the fact we were only a Class A municipality.
