    Default Retail Fraud 3rd Degree In Michigan

    i was at JcPenny and took items totaling around $175 and was apprehended soon after walking out. The people who talked to me were not security or Police Officers, but only workers who cuffed me and took me into the back room. I was questioned about the charges and such, but never read my rights (not sure if this matters) and they eventually let me walk after saying i would receive a letter from JcPenny and i would have to pay $200. I payed the money but im worried about appearing in court. I was never given a ticket or anything of the sort for this offense, and i was wondering if i was not going to have to appear in court. I contacted the Police Officer who questioned me and he told me to contact the court, so i did so. They said they had no record of my offense and it has been two months since the incident.

    Please let me know if court is still an option or if I was only required to pay the charges to JcPenny.

    It appears as store did not file charges

    Read my post in this forum, it's somewhat similar to yours, I hope that you will not have any charges pressed against you.

    im sorry i forgot to mention.. they did call the police and they came and questioned me (w/o reading my rights and such) but i contacted the court about the incident and they said they had no file on record.

    They have no file yet! They have until the statute of limitations runs out to file charges

    Thats up to them but if its been week sor months I would say it isnt likely but no guarantee
