    Default Seventeen-Year-Old Charged With Shoplifting In New York

    In Central NY, my 17yr old daughter got stealing an $18 necklace from JcPenny's, she is a good kid, this is the first time in ANY sort of trouble. Fairly good grades, clean driving record, holds down a job since Sept 07 at the same place.
    The called the police, and they took her away in handcuffs, the store employee told me they are just scaring her, but I had to pick her up at the police station and she has to go to criminal court on the 26th.
    Are they just scaring her ? or could she be facing probation, fines or jail ?

    Cause they scared her, and me ! Is there anything I can do or she can do to help lighten the penalty ? Like I said she has never gotten in any sort of trouble. We just had a horrible death in the family 1/22/08, her grandmother after a short battle with cancer, she has been really upset about this....is this something I should share with the judge ? I am not looking for sympathy, but an understanding to why my daughter made such a terrible mistake.

    I appreciate any and all your professional opinions and thoughts.

    Also, do I get a lawyer ?

    They aren't trying to "just scare her." That's a lie (police legally can lie; loss prevention can, too). They are charging her with a crime. She's 17 and fortunate that she is not 18.

    With diversion this will likely be behind her when she turns 18 and only you, she, ChoicePoint, the local police, and the Feds will have access to the information. Outside of that her background checks should come up clean.

    She may still have to answer "Have you ever been arrested for a crime?" with a Yes if she goes into the Federal or State/Local government jobs, applies for college, etc.

    They are scaring her AND charging her with a crime.

    I am thinking of going with a court appointment lawyer, since the attorney I spoke with said his fee is $500. I honestly can not afford this, not to mention I just received the letter for JcPenny's attorney's, and they are charging us the 5 times of the merchandise. The attorney told me that they can do that, but that is not what the law was designed for.....the store still has the merchandise. They know this was the first offense, why are they charging the max? And do I have any chance of neogiating this with them ?

    I get the seriousness of this, trust me I do, I have recently been discussing this with other parent, and their children or friend's children has had similar things happen, and they were not charged the max by the store, some stole more valuable items or had multiple occurances before the police were involved....why does it seem like they are making an example out of us. Seeing how these are good kids, this is a huge embarrassment to us, it's not like by making an example of us is going to "spread the word", cause we aren't talking, we're hidding. And they are not even looking into the type of "kids" that they are dealing with.
    Trust me, I am not trying to say my kids are perfect, I am not nieve, but their grades, their track record at school (or lack of) is all the proof I need, as well as they should need....but they don't care.

    Sorry, I am just really frustrated with the cost of all of this.
