    Default Virginia Emancipation Law

    hello im ariel. im 16 and living in virginia. i am trying to get emancipated from a epileptic mother who is verbally and physically abousive towards me. we are on public assistance(SSI,TANIF,child support) but my mom will not be receiving any more money from the state because i am not doing well in school. my father is in seattle and pays child support for me since he and my mother are divorced. i want to move back to new york and none of my relatives in new york are willing to let me live with them. i know my mother would not consent to emancipation so i want to know if there is any way i can get emancipated without her consent or something? how long will it take to be emancipated? and since im trying to move back to new york, is there any way i can apply for public assistance to help me out there? i will also be looking for a job and i dont care if i have to live in a homeless shelter until i have enough for my own place! please help, my family will be the end of me if i stay here!!!!

    Default Virginia Emancipation Law

    Virginia's emancipation law provides:
    Quote Quoting Virginia Code § 16.1-331. Petition for emancipation.
    Any minor who has reached his sixteenth birthday and is residing in this Commonwealth, or any parent or guardian of such minor, may petition the juvenile and domestic relations district court for the county or city in which either the minor or his parents or guardian resides for a determination that the minor named in the petition be emancipated. The petition shall contain, in addition to the information required by § 16.1-262, the gender of the minor and, if the petitioner is not the minor, the name of the petitioner and the relationship of the petitioner to the minor.
    Normally, to be emancipated, you would be expected to show that you have a stable and appropriate place to stay and are capable of supporting yourself. If you need public assistance to support yourself, the judge will likely hold that against you when deciding your petition.
