    Default Emancipation

    Hey i need a little help
    im 17 and need to move out of my house. i live in NORTH CAROLINA. both of my parents think im old enough to move out , and im planning on moving in with my cousin in las vegas, NEVADA. does anyone know how i could do this? legally of course. like do i need to get them to sign papers or go to court or something? please help me out , i need all the advice that i can get.

    Well you are asking about emancipation, but make no mention of a job. Which is a critical element when petitioning for emancipation.

    § 7B-3504. Considerations for emancipation.

    In determining the best interests of the petitioner and the need for emancipation, the court shall review the following considerations:
    (1) The parental need for the earnings of the petitioner;

    (2) The petitioner's ability to function as an adult;

    (3) The petitioner's need to contract as an adult or to marry;

    (4) The employment status of the petitioner and the stability of the petitioner's living arrangements;

    (5) The extent of family discord which may threaten reconciliation of the petitioner with the petitioner's family;

    (6) The petitioner's rejection of parental supervision or support; and

    (7) The quality of parental supervision or support.
    § 7B-3505. Final decree of emancipation.
    After reviewing the considerations for emancipation, the court may enter a decree of emancipation if the court determines:
    (1) That all parties are properly before the court or were duly served and failed to appear and that time for filing an answer has expired;

    (2) That the petitioner has shown a proper and lawful plan for adequately providing for the petitioner's needs and living expenses;

    (3) That the petitioner is knowingly seeking emancipation and fully understands the ramifications of the act; and

    (4) That emancipation is in the best interests of the petitioner.
    The decree shall set out the court's findings.

    If the court determines that the criteria in subdivisions (1) through (4) are not met, the court shall order the proceeding dismissed.

    yes, im like on the verge of obtaining a job. it'll be in the next 2 or 3 weeks im sure, ill find 1 if i try hard enough.

    When you have a job that is sufficient for you to support yourself and still go to school and keep your grades up, and a stable place to live, come back and talk to us then. There's really no point in discussing it before you meet the requirements, which are defined for you upthread.

    Proving to the court you can earn enough money to take care of yourself is a big issue. I wouldn't recommend you go to court until you have been working for awhile and can prove you are able to make enough money to support yourself.

    If you have your parents' permission, as I think Happy Trails is intimating, the primary issue is whether you can enroll in the public schools in Nevada - at least without paying tuition. You say you have your parents' permission, so you don't need to emancipate to move. (By the same token, without emancipation your parents can change their minds.)

    yes i have their permission. and we already discussed me moving in with family out there aaron. but how would i get into public schools? the only reason i need emancipation is to legally put myself in school? thats one of the big issues. that i cant get into school without them having a nevada address. they wouldnt change their minds but i just need to know how it is possible to even do so? and paying tuition isnt a problem, they used to pay tuition for my private school when i used to go. any help from any one is great! thanks

    Your parents need to look into giving the family (that you will be living with) guardianship.

    I can't really look up specifics as to what the school's policies are in regards to the guardianship being granted voluntary or if it needs to be done through the legal system.
