My husband and I have 5 boys between us (15,13,11,9 &5). I have 3, he has 2. They do not live with us, and only visit on school holidays. Their holiday breaks, as well as much of their summer break overlap. Our lease states that it only allows guests to stay for a period of no more than seven days. The father of my 5 y/o has subpoena'd me, and our lease to a deposition in order to challenge our lease, saying because of this clause, it is illegal for us to have all the children visit at one time. His intent, of course, is to control visitiation. Before the 4 older boys came for the summer visit, we spoke with the apartment manager, and she told us their wasn't a problem, and that no, they should not be listed as tentants. We have continued to speak to our apartment complex, and are working with them regarding these new court issues. I am trying to do some reasearch on my own, and my question then relies on occupancy rules within the state of Mississippi: do the children actually qualify as guests? Any help would be greatly appreciated.
