    Default Expedited Hearing In Florida

    My husband and I have just retained an attorney in Florida to ask the court for custody of his 17 y/o son. This matter needs to be expedited because the mother has not given proper care to the child (aside from different parenting skills). The attorney said he is going to go to the court during the week (not a scheduled hearing) and bring forth the situation to the judge, asking for temporary custody and then in the future, there will be a full hearing. My questions is...will all parties attend this expedited hearing, or would the attorney go by himself?

    If he used the word "expedited", that would mean a regular hearing that has an expedited date. But that doesn't mean the other party is not entitled to notice of the hearing, or an opportunity to appear and respond.

    A hearing where the other party doesn't get advance notice or appear is called an "ex parte" hearing.

    Your lawyer should be able to explain what he has requested, and what is likely to happen.
