    Default Striking Out Lines From A Contract

    I got offer from a company in MI sometime back. Now I am willing to join. As a part of joining fomality documents, they had one document that is called "Confidentiality and NonCompete Agreement" In this document apart from Non compete clause, They had paragraph "Commitment to complete 18 months of employment with company" which says I cannot leave company for 18 months typically covering 3000 billable hours. I have to pay 10000$ If I leave before 18 months. Actually this was not told to me about this clause when they offered me sometime back. So I called them and told I cannot give 18 month commitment. Then They said I can strike out that paragraph and sign and fax. I striked it with pen in such a way that nobody can read that paragraph. Is this right way I am doing or I should have asked employer to resend a new contract.

    Did you initial & date by where you striked out paragraph besides signing & dating document at bottom? However, I would certainly feel better if I had a new document w/o the paragraph in it though it may very well be ok.

    Striking it out and initaling is OK and you should note in your cover letter "executed contract with changes as noted thereon."

    Yes I did sign and dated next to the striked paragraph. But I didnot include any words on cover letter. But I mentioned at the bottom of the page that "Based on our discussion with XXX(company name) on 01/31/2008 point number 3 and 4 of this agreement are not applicable to ZZZZ(My name)".

    Hope this works..
