    Smile Valet Liability

    I am a valet in Arizona. I scratched a vehicle recently. The valet company told me that I need to pay their $500 deductible out of my own pocket. Apparently the bill was $800. Is that normal for the valets to pay for mistakes out of their own pocket? Aren't the companies responsible for mistakes made by their employees? Thanks!

    They are liable for employee negligence to the person hurt by the negligence. They aren't liable to you.

    What is your employer threatening to do if you don't pay?

    Ask to have a look at the forms you signed when you took the job. It's entirely possible that you signed an agreement to exactly this.

    You wouldn't be the first one.

    I haven't brought up not paying. But I guarantee he would just say ok and not to work anymore. I'm sure it's not worth it for a few hundred dollars to bring me to court. An update to the story is that he just recently told me he would only charge me $200 because he said the lady wansn't making much fuss about it. It makes me a little suspicious that perhaps the lady never even complained (because the scratch was hardly noticable on the front wheel well), and my boss is trying to get some money out of me. But that's just a thought I had. Maybe I'll get him to give me the receipt for repair.
