I am inquiring concerning the following.
I completed a 1 year contract working for a state agency in Texas who I understand is protected from litigation because of it being a state agency.
I was hired under a contract with company "A", which paid me compensation for my labor.
Company "A" was in contract with company "B" who paid me my per diem.
Company "B" was in contract with the state agency who was overseeing the project I was working on. I was the state agencys representatitive on site. I have business cards with the state agencys logo on it listing me as a site representative.
Because of very sloppy payroll practices, I chose not to renew my original contract for I was not under any type of automatic renewal clause past the 1 year time frame.
However, there was a noncompete clause in my contract with company "A" which stated I would not enter into any invovlement, business agreement, employment from any third party involved with the project, could not seek any type of business relationship with any company within 100 miles of the plant site, located in central Texas, blah..blah..blah.
Here is my questions:
1. Am I protected from any type litigation as a contract employee representing the state agency?
2. The state agency approached me about coming to work for them, in the same position as before, but only through another firm that was in contract with them.
3. Have I jeopardized the current agency I am working for in any way?
The original agreement between myself and company "A" was breeched numerous times, in that I NEVER received my per diem pay as contracted because of sloppy invoicing practices between company "A" and company "B".
Duplicate timesheets were sent to company "A" and "B" at the same time.
Several times company "A" over invoiced "B", who in turn over invoiced the client (state agency). This was a constant battle between the two companies.
I was over paid and under paid. I received pay checks from a company I was not even contracted to. My contract was with company "A", not a subsidiary of company "A".
In 12 months, I received payment from company "A" and the balance of the time from their subsidiary company. I inquired about why the YTD earnings on the pay stubs were grossly understated with no response given.
The state agency is in Texas.
Do I have any legal recourse in any way to protect myself, my family and my livelihood?
Please advise.
