    Default Assigning A Judgment

    New York

    A judgment was entered against me in 2005. Apparently, the original plaintiff sold the judgment and now a collection agency wrote to me claiming that they now own it. Wouldn't any court papers have to be filed at the same courthouse where the original juddgment was filed? All the collection agency sent me were copies of the original judgment file and there is nothing there about any assignment.

    The lawsuit would have to be filed in the county where they can find you or where you live.

    That is the GENERAL rule.

    The judgment was already issued against me, though. The collection agency has only sent me a copy of the original judgment (the one with the original plaintiff's name on it). If they were the successor-in-interest, wouldn't they have to file an assignment with the court to get the judgment into their name? And/Or, wouldn't the court issue a revised judgment with the collection agency's name on it?

    A: They should.


    Q: And/Or, wouldn't the court issue a revised judgment with the collection agency's name on it?

    A: If they file an assignment with the court, that does not change the judgment per se; just changes whoever it is who is supposed to get the dough.

    Just want to know if the Law of Alienation of affection still exsist in Mississippi and if not when was it abolish
