    Default Unwanted House Guests

    I recently moved into a home in San Diego, California with my boyfriend and one roommate, who are all on the lease. We had two friends being kicked out of the expensive studio they were renting, and offered to let them stay with us. They paid $500 for one month's rent, with the agreement that they keep the room clean, pay for their own food, and move out by February 15th. This was orally agreed upon and witnessed by all of us before exchanging money. On the 15th, our permanent roommate would move in, and be added onto the lease.

    Our guests, however, have been less than thankful. The initial attempt to help them get on their feet (they were paying $1000 a month for a studio they couldn't afford) seems to be ignored in favor of constant demands for rides, food, money, etc. They do drugs (medical marjiuana, lsd, and others) in their room, which potentially breaks our agreement with the landlord (no smoking inside). They have been rude, vicious, insulting, and generally poor guests. We initially tried to talk with them calmly, which led to an all out argument and they threatened me with violence.

    I really want them out. We don't have a written agreement with them (my bad) and I have to stay locked in my room out of fear. But because they did pay us for a month, I'm not sure what the legality of the situation is. Can I refund them the money for the days they aren't staying here? Can I even remove them before the 15th? I'm at the point I just want to put their things in the driveway and let them deal with it, because I'm so tired of feeling afraid and hurt in my own house.

    Evict them under your state's landlord-tenant law.

    The fact that you made an agreement and accepted rent does not make them guests; they are your tenants. Giving them back the money doesn't erase that.

    u diddnt kno this stuff about them prior? oh and u can probally evict them withe 2 days with the drug usage.

    All they told me was that they smoked... and I figured cigarettes, and they agreed to smoke outside before I would agree to anything. Again thanks for the help.
