Default Usage Of Sprites From An Online Game

Hello, I am new to this forum, and I came here to ask a question, I have yet to find anyone to answer. I know for games, such as flash games, you may use sprites from other real retail games, just as long as you don't sell the game. But is it the same for online games? I want to use the sprites from the game VMK, http://www.vmk.com. It is completely free, as there is no monthly pay, or pay to get the game. Its a game like habbohotel. Am I legally able to use sprites from that game, to make an online game of my own? If not, can I use them to make an offline game? Thanks

If they own the copyright to the sprites, you need their consent to use their artwork.

Er... I just followed the link. You're planning on using Disney's intellectual property? Disney is incredibly protective of its IP rights.

    That's rather understating it.

Disney is so vicious about protecting its IP rights that their NDAs for certain tech development contractors often forbid them from even listing Disney on their resume.

This is not strictly true. I promise you, if Disney catches you using their property for a Flash game, they will ride down on you like the wrath of god and sue you to within an inch of your life.

Don't use other people's characters without permission. Keep your butt covered.

Ok thanks. So I can't use their sprites without their consent. What if I were to draw sprites myself, which look like the sprites form the game. Not exact, but close. Would using the idea of the sprites, cause comotion? Thanks again.

Ideas and concepts can't be copyrighted, only the actual work.

Be cautious, though. If it looks too much like the VMK sprites, you could be in for trouble. You're best off going with an original design.

Oh Ok. Thanks. I think I will just stick with my own original creations then. Thanks so much everyone.
