I live in Michigan and went through chapter 7 bankruptcy approx 6 years ago. The mobile home that I live in is in a park and the mortgage was never reaffirmed. After trying to sell the unit for over 6 months, my family and I moved out and can no longer continue paying for it. I've called GreenTree and they said that since there was no re-affirmation, we can call and tell them that we are not going to make any more payments and that they will take the home back.
I am going to stop making payments on the home as of now but Greentree insists that I have to continue paying them for insurance until they complete forclosure 2-3 months from now. Also, who is responsible for the lot rent. I do not have a contract with the mobile home park.
Talking to someone from another park, they were told by their park manager that this happens all the time, I stop paying lot rent, they take me to court, I show up and tell the judge that the home belongs to greentree and they are responsible for the lot rent. Greentree has already told me they were going to come in the day after I call and winterize the place and change the locks. As I will not have access to the property, I'm being told it's considered "seized" and I'm not responsible for insurance nor lot rent.
Not sure which way to turn on this one, can't afford the lot rent nor the insurance but also don't want to get in trouble with the law.
