    Default Unemployment Ineligibility Notice Requirements In Illinois

    I have been unemployed in Illinois since December. I didn’t file for unemployment benefits right away mainly because I thought I would find similar work quickly. Now I’m thinking about filing for benefits. But there seems to be some disagreement with my ex-employer about the circumstances surrounding the termination of my employment which was involuntary. Without getting into all the details of he-said she-said, I would like to know if I go ahead and make a claim - how long do they have to dispute it? I don’t want to be faced with tracking down witnesses and evidence after six months go by. I’m not sure if this is correct, but according to the Illinois Unemployment Act Guide, the employer has 10 days to dispute my claim for benefits. It isn’t clear if this is a one-time requirement at the start, or a reoccurring option every two weeks.

    The 10 days that your employer has is from the date that the decision goes out. If the decision is against you, you also have 10 days to contest it. The burden is always on the employer, but when one party contests the decision, then the burden falls on them to persuade the hearing officer to side with them.

    He has 10 days from the day the UI agency contacts him to dispute your claim. Once they make their determination, that's it. He can appeal once.

    You may have a tough go of it if your separation was involuntary, and not due to lack of work available. Gather up your evidence, because you will be asked questions about your separation when you file.

    Thats incorrect Missy. Either party can appeal to the board of review and then to the state supreme court if they disagree with the decision handed down,
