    Default Stepson Is Now 18

    I have a question about child support with my husband's son. He had just turned 18 years old few weeks ago and he's still in school. He will graduate next year of 2009. Well, since last two years, he moved out of his mother's house and moved in with his aunt. The child support still went through to his mother and his mother refused to give money to his aunt to support my husband's son. So his son had to work for the past two years to support himself and now he had to get two jobs. I don't like the idea of him having two jobs but his mother still refused to give him the money that my husband is still paying. My husband called the child support welfare last year and asked if they can transfer from his mother's name to his son's aunt's name but they refused bec he is still a minor before 18 years of age. I wonder if it's possible to transfer from his mom's name to his son's name now that he is 18 years old? How does that work? I need advice bec I do not want my husband supporting his ex wife with his son's child support money! Thanks

    Probably not.

    I've never heard of Child Support being paid directly to the child, only to the custodial parent or legal guardian. Child Support is not meant as an "allowance" for the child, but rather as a means to help pay for the costs of raising a child, including feeding, clothing, housing, insuring and transporting the child.

    If the child has indeed moved out of his mother's home, your husband - not you - needs to speak with an attorney about a modification.

    Forgo the modification, and look into emancipation. Depending on the wording of the decree, he is probably, or at least maybe emancipated as e speak. And child support should stop.

    I agree. File immediately to stop support based on the fact that he is emancipated. Then you can give him the money directly.
