    Default AAFES Going After A Spouse

    I need help too! I hate AAFES and I have never had an account with them. My husband is a disabled vet. He had an AAFES account with his ex wife. After they divorced, he filed bankruptcy. Now that we are married AAFES is pinning the debt on me. Are they allowed to do that? We were not married when he had the account and he filed bankruptcy before we were married. He contacted AAFES right after the bankruptcy so they would stop contacting him. Now it is 2+ yrs later and they send me a letter saying I owe the 2500 debt and I sent them my husbands lawyers info. Now they are garnishing my tax return, which is technically ours. I didn't even work last year! All the money earned on our taxes was my husbands. I am so furious because this is not my debt, how can they take my money. Why arent they going after his exwife? She was on the account with him. I need help!

    Someone please tell me they are not allowed to do this!
    My husband and his ex wife had an account with AAFES. They divorced. He filed bankruptcy. We get married. Now it is 3 yrs later and they are trying to collect the debt from me. They sent a collection notice with my name on it. I sent them my husbands lawyers contact info. 1 month later, my taxes are being garnished for the 2500 dollars owed. The account was last used by my husband and his ex in 1999. We didn't get married until 2004. How can they pin this on me? My husband filed bankruptcy, so doesn't that end this debt? Why haven't they gone after his ex for the money? Someone please give me some answers.

    There's a lot AAFES can do another debtor can't. Being a quasi-Federal agency, they can garnish tax refunds without bothering for a court judgement. I don't believe even bankruptcy can stop an AAFES debt - much like it can't forgive a tax debt or a student loan debt, or other categories. (Indebted to AAFES = indebted directly to Federal Government)

    However, they can't transfer a debt to a spouse not a party to the original debt, but I can tell you that AAFES hires people at a pittance, so it's always possible you're dealing with someone earning $8-9 an hour who is simply looking at the DEERS record and just not doing the homework. If they're contacting you directly, it's likely they're not closely reading the file and dates of entitlement in DEERS (your marriage vs the date of debt).

    You could go directly through AAFES leadership channels, current commander, Major General Keith L Thurgood or inquire on how to contact the AAFES Inspector General to have this situation looked at. If you get no answer, then contact your Congressman and have a Congressional inquiry filed.
