    Default May Want Roommate To Move Out

    I rent a great little house in California and have live within the house community for about seven years. The rent is very affordable and it is a comfortable place to live.

    When I originally move in it was by myself in a two bedroom house. Time got rough and I needed a roommate to help fill the void. A good friend of mine move in due to him needing help and relocating, so, I obliged. The original place we lived in was too small and soon the house next door became available. The landlord was kind enough to allow us to move in and transferred my deposit over with us. When time came to sign the lease I was still the primary lease holder and still am. However, my roommate signed a contract with the landlord as when.

    I am missing the benefit of living alone again and would like him to move out. All the bills are under my name and the security deposit. I talked to my landlord about it and he told me I have to have a good reason to evict him and not just to have my space again. What would be a good approach towards this? My roommate has a good friend involved in real-estate that may stir something up to complicate the situation.

    The lease is binding. Your landlord is correct in that you need to have a good (legal) reason to evict him, such as failure to pay rent.

    Wanting your space back does not fall into that category. He is legally permitted to be there til the end of his lease term.

    Do I understand you correctly that he has a separate lease agreement with your landlord?

    The best thing that could be done is to be honest with the roommate. With honesty, you would most likely regain your privacy and retain the friendship as well, if it is important to you.
