    Default Time limit for opening the case

    I had a shoplifting charge in NJ and I pleaded guilty to petty offence / disorderly conduct in court. Now I think it takes 5 years to get the record erased in NJ.

    It has been 2 weeks since my court and now I am thinking to get the case re-opened and go for a trial. Is this advisable?

    What is the outer limit for getting a case reopened?

    You mean, after a guilty plea? After both a plea and sentencing?

    If you are serious, you should consult a lawyer to help you. Getting a court to set aside a guilty plea is usually an uphill battle.
