    Default Unwed And Pregnant, Whose Name Do I Give My Son

    I'm 6 months pregnant with my first child, a son. His father and I are unable to marry until after the child is born. I wonder, based off of Florida Law (I've looked and will keep searching for an answer to this) Is my son required to have my last name, or can I give him the surname of his father at birth?

    You may name the child anything you wish. Once paternity is established the Father may seek a name change if he wishes and let courts decide

    why can't you get married prior to the birth? Wouldn't that solve your dilemma?

    I am guessing the Mother and/or Father are minors

    Having a child does not typically emancipate a minor.

    I was thinking more of a state aid situation but wanted to let her know that the dad is going to be held liable for the child's expenses whether they are married or not. Actually, if they are married and are still eligible for state aid, it would actually be more cost effective for them.

    but that is only speculation

    You can give your child any name you wish. However, you will not be able to state who the father is unless the father signs an affidavit of acknowledgement of paternity at the hospital when you fill out the BC papers.

    A social worker will come into your room to answer any questions you have concerning the name and affidavit. In some hospitals the SW doesn't come in automatically, so you might need to ask your nurse about it.

    I'm 19. He is married but has been separated for 2 years. They have had some issues for a while that will lesen enough that the divorce can be pulled through in time, meaning if we decide to marry it would have to wait until after the birth.

    Letting you know I found information on paternity affidavits and claims and will use this in my future plans.

    Thanks for your help, I will update you if I think of another related issue.

    Oh, so the birth of the child has nothing to do with being able to get married like you inferred in you previous posts.

    There is a huge difference between; we have to wait until the child is born to get married and;

    he is still married so we can;t get married until sometime in the future when/if his divorce is finalized.

    Has anybody even filed for divorce?

    Sure hope this works out but honestly, this sounds like one of those situations that do not work out well.
