    Default No Walk Through - How Do We Prove Prior Damage?

    My landlord did not do an initial walkthrough when i moved in. There was some damage & minor issues with the place and it was not even close to being clean. There were some tears & spots on the carpet, which was obviously old and the paint job was awful (lots of runs & smears). I'm worried due to other issues that he is going to charge me for repairs/painting or carpet replacement. When we move I will of course clean the place and have the carpets cleaned but if there was no initial walk through does he have legal grounds to charge me for previous damage?

    Were you given a move-in checklist to complete? If you were not, did you make some other note of the existing damage?

    Without records, it may be difficult to prove that the damage was pre-existing. What state are you in? I can point you to the appropriate landlord tenant statutes.
