My husband was fausly accused by his ex-girlfriend (mother of his 8 year old son...who HE has SOLE custody of since 2001) of hitting her. His lawyer told him to plea "no-contest" so that he would get a lighter sentence but the judge said that he was "making an example of him". This is the only thing on his record and he is in his mid 30s. He has a lawyer right now who tells him that in order to do anything she has to either put in writing or verbally say that she lied about him ever hitting her. Yet, when we aquired this lawyer the ex WAS around and just after she was blackmailing him for custody of his son. She is no where to be found and without her statemtent we do not know what to do. We have contacted many legal and law enforcement and have been told that she does not have to do anything to get an expungement. Is this true or are we just being lied to by both sides? What are our options? He did not do it nor would he ever do that. Can someone help us? We live in Texas and he has always wanted to become a law enforcement officer. We think that is why his lawyer told him to plea "no-contest". Please help.
