    Default No Visitation No Child Support

    Hi
    I am in Texas. If a parent who is told to pay child support and have not due to lawyers yet to file paperwork since Nov 2007-still have rights to see the children? If they have and are providing the health care requested but lawyer not yet sublitted paperwork to Attorney Generals office for the child support--can the other parent withhold visitation due to non payment of child support? All they want is the $$.
    The parent will not give cash to the other parent so wants to go thru A. Generals office to protect them.
    How many times does a police report need to be filed on them til they ( ones withholding visitation) can be hauled to jail or court for it?

    Is there a court order for custody/visitation (well, in TX, conservatorship?)

    Child support is not an entrance fee to spend time with children. There is one state that I personally know of that lack of support may impact the visitation (after it is brought before the court, of course). Tx is not that state.

    Yes there is and it was decided in court on 11-21-2007 but as of today his lawyer still has not filed the paperwork. My niece did not have a good lawyer & she is to pay $200.00 a month for her 2 girls which is fine but the dad wants her to give him cash since he does not work or hardly does.
    The standard 1,3&5th weekends, holidays, etc and she does pay the health insurance but as of last week he denied her her weekend...he did not want to let her see them at Xmas but police intervened. He has not shown up for drop offs so she goes right into the police substation & filed a police report on him. She already has police reports for harrassment on him & her. Also, when he is in contempt of the orders how soon can he be repsonsible for it?

    She does not need to give him any cash. That is the worst thing she can do. CS is retroactive to the date of the order so she will have to pay twice if she gives him cash. Her attorney needs to file for a hearing to hold him in contempt.

    Number one, she does not need to give him cash. In fact, she should not give him cash. She needs to send the checks through the attorny generals office. They have an address in San Antonio that she can send it to. If she pays with cash, there is no real record of it, and he can just say she never paid. Second, he cannot hold the kids from her at all. Bad thing is that in Texas, most police dont like to get involved in custody disputes. Tell her to bring a copy of the court order with her every time that she goes to pick the children up. If he continues to do it, ask the court to provide an officer of the court to oversee the hand-off of the children.

    Bad thing is that in Texas, most police dont like to get involved in custody disputes. Tell her to bring a copy of the court order with her every time that she goes to pick the children up. If he continues to do it, ask the court to provide an officer of the court to oversee the hand-off of the children.
    ...or seek help for enforcement of the court order from the constable.
