    Question Employer Terminating Me For Not Accepting New Hours And Days

    I am in New Orleans, La and I have a question regarding my rights as an employee. Last week I was told that I have a change of hours and a new position as a assistant to a Area Manager. I am a Project Manager at this present time. The location that they were moving me to has more responsibilities that I have at the present moment. I did not agree to this because when I was hired these duties were not presented to me. I feel that if I am going to take on more responsibilities I should receive higher pay. They refused to pay me more and told me to wait 90 days to prove myself. They told me that they could move me whenever wherever they wanted to to fulfill operational needs. The truth of the matter is that another employee with a H1B Visa has to work nights instead of days. This employee is taking over my position while I'm being forced to move somewhere else. I feel that this is unfair. They claim that they are moving me because they feel as if I am the person for the job.

    Well today I was suspended. I was suspended because I refused to go to the new location over the weekend. They considered me a no call no show on Saturday and Sunday for not going. They asked me if I would like to resign or take on the new location. I told them that I will not resign. I have until Wednesday to give them a answer. What should I do?
    I know that being terminated is bad but if I resign what is the difference between the two?

    If you resign they can fight any unemployment claim you make but even if terminated they can still fight it as you refused work so its up to you

    as to unemployment and firing. I'm not familiar with La. UI but in some states, a change of job that requires a distance greater than a certain distance from your current job and quitting because of that does not DQ you from recieving UI.

    Call the agency in your state that deals with UI and ask them for the specifics.
