    Default Landlord Notice Of Entry To Show House

    We put in our 30-day notice for the house we are currently leasing in Texas. My landlord advised me that he was going to start showing the property. Upon requesting that he give me a call prior to entry (we have a large dog that will need to be contained and I have a 14 year old minor child that is home by himself after school), he informed me quite blatantly that he has a right to show the property without any notice once a 30-day notice is given. Is this correct? Is this not still my dwelling (as we are paid up until the 1st of next month) or do I revoke my rights once I give a notice of move-out to know when someone will be entering my home? I have no desire to deny entry only to ensure my child's safety and make sure our pet is secured? I can find no reference to this in the Texas Property Code. If anyone can provide me with a statute or documented legal right, I would be eternally grateful.

    What does your lease say?

    Study your lease carefully to determine the circumstances under which the landlord may enter your home. Unless the lease agreement says the landlord can enter your apartment or house, she has NO right to do so, except in emergencies and for routine inspections or repairs and, preferably, when you are given advance notice. In every residential lease (oral or written), a tenant has an implied right to peaceable, quiet enjoyment of the premises. A tenant also has a right of privacy in her own home.

    If the lease says he can show up without notice during the 30 period before you leave, then he can. The Texas Tenants Advisor notes that Texas has some of the weakest tenant protection laws in the country.
