    Default What are the cercumstances for changing Custody

    My question and if any help is needed. Im a mother of 2 boys ages 8 & 6 I have been divorced since 2000. When I was divorced my ex husband got custody of the children because i gave them to him. Reason: I was hoping that he would realize how it felt to work full time and come home to 2 at the time very small children. Well it back fired on me. As soon and the papers where signed He moved back in with his parents And dumped the children off and left. Since then the two children have been in her care. There father hasnt had a job Since 2000. He lives off of whom ever he can and lives where ever he can. There father has Never in almost 6 years Had them over night. He takes them once in a while to his girlfriends house then returns them home,becuse his mother too knows about her Meth problem. My question i guess is this. His mother receives the 400.00 in child support that i pay. Granted its in there fathers name since he would blow it all on booze and drugs. He also doesnt give anything for the children and gets by scott free,which isnt right. His mother also claims them on her taxes since there father doesnt have a job. I think that since their father doesnt work i should have the choice in the tax deduction. But to get to the point here. I work 2 job to support myself and pay child support I have wanted my children back for 5 years now. His mother and himself keep making me jump threw hoops telling me i cant date this person or i cant have my children around my boyfriend. ( because he has more to do with them then their father does.) Their father hasnt had a job since 2005, doesnt have a licences. His girlfriend has been on drugs so i would think he would be doing them as well. He's got a seiouse drinkin problem and There grandmother has been charged with welfare frawd. Case is still pending. I dont want my children subjected to this kind of living. There grandfather has been charged with perchusing stolen items, and the list can go on and on and on ... Ive asked my children who they would want to live with then continue to answer living with me. What can i possibly do to remove My children from this life style? and what are my chances of winning this case? Any Information will be greatly appreciated. Or any kind of links. I have little money so keep that in mind.

    Default Regaining Custody

    To get the children back, you will likely have to go to court and get an order modifying custody. If you have limited resources, the ABA describes options for low-cost legal help.

    Default Update Information Tell me what to do know!!

    Well heres an update on 1/5/06 both grandparents were sentanced to jail and have to repay the welfare and spend time in jail. I find this UNEXCEPTABLE Living conditions for MY CHILDREN. I want to know what i can do to reverse the child custody and put them children back where they belong. Please somone Please tell me the route i should take for fast action! thanks for all who reply.

    im not a lawyer, just here for advice as well, read your post and my heart goes out to you. where are the children now? i would believe that since there is criminal activity involved children be put in foster care or should actually been placed in your care. not sure of the state laws in your state. how old are the children? i noticed your last post was on the 6th of january. hope things have worked out by now.

    The circumstances for this case would be dictated by your origional divorce decree. If he has abandoned the children, and they are living in an unsafe environment, you need to file a petition to change custody. Here in Michigan, the filing fee is $100.
    Some divorce decrees state where and with who the children are to live. Your ex can't just give custody of them to another relative, he is legally responsible.

    If the facts in this case are as your describe them, another option would be to contact the child welfare office in your area, and file a complaint. They will investigate the living conditions, and if necessary remove the children from the home. If your living conditions are acceptable, custody would pass to you.
