I have lived at the same apartment complex for almost three years. In April of 2005, I recieved a lease renewal and placed both signed copies in the night drop box as assigned. I signed 2 copies of the renewal and one copy was supposed to be signed by the property manager and returned to me for my records.
I never received the signed copy back, but thought it would not be a problem as long as a copy was in my file. I had two months were my rent was late, because it was paid on the 3rd rather than the first. I incurred late charges and asked about these charges. I was told that if rent was not paid on the first that I would then be responsible for paying the market rent of $954.00, plus late charges. A little steep, but fine I paid it.
Now a new company has purchased the apartment property and they are trying to say that I have a month to month lease and charge me over $1000.00 in month to month fees for the last two months of rent. I provided them with the cover letter from the previous property manager that was attached to my April 2005 lease renewal and informed them that I did not recieve a signed copy back from the office, but here is proof that I did recieve an apartment lease renewal in April 2005.
Can anyone offer help here regarding this matter? They claim that my lease is not in the file. That is not my fault if the previous company dropped the ball. I pay $704.00 in rent every month. If you are transferred month to month, don;t you have to sign something acknowleding that?
