    Default Under Chapter 13 And Facing Layoff

    I am 4 1/4 years into a 5yr plan(old law)--due to the economic turn down
    I am about to be laid off--Chap 7 is not an option--I have been i my
    house for 25 yrs and never missed a payment---the debt was credit cards
    --can anyone offer advice or tell what will happen(in Virginia)

    Well, hopefully you will get another job and continue with your plan and go on with life. Is there some reason to believe this cannot happen?

    Ask your attorney to contact the Trustee and request you be excused from one month's payment due to your layoff. This will extend your plan length by one month of course, but providing the Trustee grants permission, it would keep you from facing dismissal from the Ch 13.
