Yes, I am aware of that as I mentioned. In a nutshell, in most cases I must disclose all arrests and dispositions; but as you can see I do not know the exact disposition because it is not listed anywhere...it is incomplete. In my attempt to contact the arresting agency they have informed me as well, that their information is incomplete. This was an e-mail communication and I have yet to visit them in person. I mean really as far as I can tell, it is a "detention only" because it did not move beyond surrendering to the arrest warrant. After all, I never saw a case file back then and the hall of records shows no action on the case number whatsoever. If it had gone to the arraignment date, I certainly would have seen a case filing, but it did not happen apparently. I have no idea why it did not move beyond the recalling of the warrant.

There is a law in California that is entitled "Supression of Incomplete Criminal History Information"--Title 11, Division 1, Chapter 7, Article 2. It does not include any exceptions to this supression whatsoever, meaning all of the incomplete information is supressed no matter what if the DOJ cannot verify the disposition. So if I apply for a sensitive position the incomplete info will be supressed in the background investigation, it cannot be released. The penal code also outlines the same factor for peace officer applicants if the disposition is missing, I don't remember the exact section though.

All fine and good; it won't show up on the background investiagtion. But as I stated I must reveal it during the application process--especially if I was partly fired from a job I held in the past for that very reason. But, with another twist, that employer destroyed my employment records some time ago---so there is no document about that either, except what I have saved from back then.

So next I will visit the arresting agency and see what type of document they can perhaps give me if anything, although I do believe they must give me something. If anyone else can chime in about what I could perhaps do besides this I would appreciate it.
