    Default Home seller suing me in civil court.

    The person I was buying a home from has fraudulently, brought 5 counts against me in a civil case and the same on a criminal case. I was finally appointed a public defender for the criminal case and it was dismissed, however I am still facing civil court and I took such a loss from the first attorney I hired and had to let go because of big mistakes she had made, This being said I am representing myself and I believe that I have missed my chance to counter sue for fraud, because my first attorney did not request it in the original answer, she did put that my defense is fraud on the plaintiffs part. I believe she should not ever be able to get away with this again and that once I prove my case she should be accountable for her wrongful actions. I have called the plaintiffs attorney everyday for a week to get together concerning my case and he will not return my calls. I have let the court know that I will be representing myself and I am sure the judge is thrilled about as much as myself, but I am broke now and no one will take my case on a contingency because the plantiff has gone through legal aid and is presenting herself as poverty stricken, which I have proof of otherwise. Is it legal for her attorney to avoid contact with me concerning the case since I am my own attorney? My court date is November 4th, I am down to the wire here and I have done so much work to prove my case and I am confident in this but I went to jail on the criminal side and that scared the heck out of me because no one bothered to ask for my evidence until six days later when a public defender got me out, so I want to be careful and try my best to do this right. Any help would be a blessing to me, so thank you ahead of time..

    Yes.

    You should consult a lawyer about the possibility of bringing a counter claim, or a malicious prosecution claim, or some other claim against this person. Even if it is just a "free initial consultation", or an hour or two of time you have to pay for (in which case you should also get advice about representing yourself at trial).

    I don't know the fine points of the law in california, but you should have the ability to file your questions (interogitories) with the court and have a set date by which the opposing party has to respond. Check your district court's website to see if they post the courtroom rules.
